Terms of Service

Welcome to CubiqHost ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our web platform, game server hosting, virtual private servers (VPS), digital products, and associated support channels (collectively, the "Services").

By registering an account, placing an order, or accessing our Services, you ("User," "Client," or "you") agree to be bound by these Terms. If you do not agree with any part of these terms, you must exit the platform immediately.

1. Definitions & Scope

• "Services" refers to game server instances, VPS nodes, network bandwidth, support tickets, and digital configurations provided by CubiqHost.
• "System Abuse" refers to any action that intentionally or unintentionally degrades server node performance, compromises security, or violates shared hardware boundaries.

2. Account Eligibility & Registration Security

• Age Limit: You must be at least 13 years of age to register or use our Services. If you are under 18, you must have parental or legal guardian consent.
• Accuracy of Data: You agree to provide true, accurate, and complete registration and billing details. Fake identities, disposable email addresses, or proxy details may result in instant account termination.
• Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity performed under your account is deemed your sole responsibility.

3. Acceptable Use Policy (AUP) & Prohibitions

To preserve shared infrastructure integrity, you strictly agree not to use CubiqHost services for:

• Malicious Activities: Denial of Service (DoS/DDoS) attacks, port scanning, network flooding, or hosting phishing pages.
• System Overloading: Attempting to bypass CPU, RAM, or storage limits allocated to your instance.
• Cracked/Pirated Content: Hosting, distributing, or executing unlicensed, cracked, or nullified plugins, software, or files.
• Resource Mining: Cryptomining, execution of background torrent clients, or running highly unoptimized automated scripts.
• NSFW/Illegal Content: Hosting adult material, copyrighted files without explicit authorization, or any content deemed illegal under local jurisdiction.

Violation of the AUP will lead to immediate service suspension without warning, loss of refund eligibility, and potential termination.

4. Billing, Payments, and UTR Auditing

• Prepaid Model: All Services operate on a strict prepaid basis. Setup or renewals are only initiated upon verified successful payment.
• UTR / Transaction ID Submission: For UPI or bank transfer payments, you must enter your exact 12-digit Unique Transaction Reference (UTR) or Transaction ID. Our administrators retain full auditing access to these IDs to match our banking ledgers, prevent billing spoofing, and arbitrate double-payment claims.
• Renewal Grace Period: Suspended services due to non-payment will remain in our database for exactly 7 days. After this grace period, all data, backups, and configurations are permanently and automatically purged from our nodes.
• Chargebacks & Disputes: Initiating payment disputes without prior contact will lead to immediate service termination and blacklisting of your identity.

5. Service Level Agreement (SLA) & Maintenance

• Uptime Target: We make reasonable efforts to maintain a 99.9% network and node uptime.
• Scheduled Maintenance: We reserve the right to initiate scheduled maintenance or emergency reboots. We will attempt to notify clients via Discord or Email, but emergency reboots to protect hardware integrity may occur without prior notice.

6. Limitation of Liability & Backup Indemnity

• User Responsibility: You acknowledge that game configurations, database tables, and world saves are your own property. CubiqHost provides backup features, but you are solely responsible for maintaining independent, local backups of your data.
• No Liability: CubiqHost shall not be liable for any data loss, corrupted configurations, loss of profits, system downtime, or business interruptions under any circumstances. All Services are provided on an "as-is" and "as-available" basis.

7. Developer Marketplace, Commissions & Discord Ticket Policy

CubiqHost facilitates an independent Developer Marketplace. By hiring a developer or working as a developer on our platform, you agree to the following terms:

• Independent Contractor Status: Developers listed on our platform are independent contractors and are not salaried employees of CubiqHost.
• Commission Split: All price negotiations are managed directly between the Client and the Developer. Upon a successful agreement, CubiqHost retains a flat 20% platform commission to cover hosting, maintenance, and transaction handling costs. The Developer receives the remaining 80% payout.
• Strict Discord Ticket Policy: For your protection, escrow safety, and quality assurance, all negotiations, payments, and project files must be managed strictly inside the official CubiqHost Discord Support Tickets.
• Direct Message (DM) & Bypassing Ban: Any attempt by a Developer to invite a Client to Direct Messages (DMs) or external platforms to negotiate or conduct deals privately is a major policy violation. This will result in an immediate, permanent platform ban of the Developer, forfeiture of pending payouts, and potential restriction of the Client's account if they participated in the bypass.

8. Governing Law & Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi/Noida, India.
